If you do not agree to these Terms, please do not use our Services. These Terms apply to all users, including businesses and their representatives who use our platform.

2. Description of Services

Receptabot provides AI-powered virtual receptionist services that answer phone calls, schedule appointments, transfer calls, and perform other receptionist duties on behalf of your business. Our Services include call handling, appointment scheduling, lead qualification, and integration with third-party software systems.

3. Account Registration

To use our Services, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your account information
• Accept responsibility for all activities that occur under your account
• Be at least 18 years old or have legal authority to enter into contracts

4. Service Plans and Billing

Our Services are offered through various subscription plans with different features and call allowances:

• Free Trial: Limited trial period with 25 calls to evaluate our Services
• Starter Plan: 125 calls per month
• Professional Plan: 300 calls per month with additional features including HIPAA compliance
• Enterprise Plan: Custom solutions with dedicated support

Billing occurs monthly or annually based on your selected plan. All fees are non-refundable except as required by law or as specified in these Terms. Calls exceeding your plan's allowance may incur additional charges.

5. Acceptable Use

You agree not to use our Services to:

• Violate any applicable laws or regulations
• Engage in fraudulent, deceptive, or misleading activities
• Harass, abuse, or harm others
• Transmit spam, malware, or other harmful content
• Interfere with or disrupt our Services or servers
• Attempt to gain unauthorized access to our systems
• Use the Services for any illegal telemarketing or robocalling activities
• Misrepresent the AI nature of the receptionist when legally required to disclose

6. HIPAA Compliance

For Professional and Enterprise customers in healthcare-related industries, we offer HIPAA-compliant services. A separate Business Associate Agreement (BAA) may be required. It is your responsibility to ensure that your use of our Services complies with all applicable healthcare privacy laws and regulations.

7. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, software, and AI technology, are owned by Receptabot and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.

8. Data and Privacy

Your use of our Services is also governed by our Privacy Policy. By using our Services, you consent to the collection and use of information as described in our Privacy Policy. You retain ownership of your business data, including call recordings and customer information, subject to our right to use anonymized data for service improvement.

9. Service Availability

We strive to provide reliable 24/7 service but do not guarantee uninterrupted availability. We may temporarily suspend Services for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.

10. Limitation of Liability

To the maximum extent permitted by law, Receptabot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our Services. Our total liability shall not exceed the amount paid by you for the Services in the twelve months preceding the claim.

11. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our Services will be error-free, uninterrupted, or meet your specific requirements. The AI receptionist may occasionally make errors in understanding or responding to calls.

12. Indemnification

You agree to indemnify and hold harmless Receptabot, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our Services, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

Either party may terminate the service agreement at any time. You may cancel your subscription through your account settings or by contacting us. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Services will immediately cease, and we may delete your account data after a reasonable retention period.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our Services after such changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or our Services shall be resolved through binding arbitration or in the courts of competent jurisdiction.
